President of the Curia

The 14 members of the National Judicial Council (NJC) are elected by the Conference of Judges by secret ballot from among the delegates. The members of the NJC shall perform their duties without remuneration and in addition to their judicial duties, but shall be exempted from judicial duties to the extent necessary for the performance of their duties. Holding the elected office has no effect on their position or on the exercise of employer’s rights, but the members of the NJC are protected by law in that they may not be recalled and disciplinary proceedings may be brought against them only with the consent of the NJC.

Membership of the NJC shall be terminated:
  • at the end of the term of office,
  • upon termination of judicial service,
  • upon resignation from membership of the NJC,
  • if disciplinary or criminal liability has been finally and definitely established,
  • if a member is disqualified by law from holding office, whose judicial status is suspended by law or who has a family relationship with the President of the National Office for the Judiciary, the President or Vice-President of the Curia, the courts of appeal or general courts,
  • if the member has been excluded from the membership of the NJC by a decision of the NJC taken by a two-thirds majority of its members for culpable breach, persistent breach or serious neglect of his/her obligations as a member of the NJC,
  • the assignment to the judicial level at the time of election is changed and, as a consequence, the number of elected judges representing that level exceeds the number provided for by law (1 judge of the Administrative and Labour Court, 1 judge of the courts of appeal, 5 judges of the general courts, 8 judges of the district courts).
A member of the NJC may not exercise the rights and duties arising from membership during disciplinary proceedings or criminal proceedings against him/her, except in the case of proceedings based on a private prosecution or a private prosecution by a substitute prosecutor, or during proceedings for a declaration of unfitness to sit as a judge. At the same time as the election of members, the delegates shall elect alternates in the same number and at the same level of the Court as the elected members. If a member ceases to be a member, the alternate member corresponding to his/her level shall automatically take his/her place in the order of the votes received. If the number of alternates has fallen below 5, an election of alternates shall be called for, provided that the smooth running of the Council or the ceilings corresponding to the judicial levels cannot be ensured.
